Wonderpay shall make reasonable commercial efforts to provide uninterrupted access to the Wonderpay Services, subject to planned maintenance, upgrades and external factors beyond its control. However, the Merchant acknowledges and agrees that the Wonderpay Services, APIs and systems may not be uninterrupted, errorfree or free of viruses, malware or other harmful components.
Wonderpay disclaims all warranties, express or implied, written or oral, including but not limited to any warranties of merchantability, fitness for a particular purpose, accuracy or noninfringement, to the maximum extent permitted by law.
Wonderpay has no control over the Merchant’s own systems, or telecommunications and internet infrastructure used to access the Services;
The Wonderpay Services may be temporarily unavailable due to circumstances such as maintenance, technical failures, hacking, network issues, force majeure events, or suspension required by law or to prevent fraud;
any material or data downloaded or otherwise obtained through the Services is done at the Merchant’s own discretion and risk.
any interruption, suspension or termination of the Services;
loss of data, loss of profits, loss of business or consequential damages;
product quality, delivery, refund or service related claims between the Merchant and its customers;
fraudulent or unauthorized transactions originating from the Merchant’s systems or customer actions;
failure or delay in performing its obligations caused by acts or omissions of the Merchant, lawful actions by Wonderpay to comply with regulations, or events beyond Wonderpay’s reasonable control.
Wonderpay’s sole obligation, and the Merchant’s exclusive remedy, in the event of an interruption or unavailability of the Wonderpay Services, shall be for Wonderpay to use reasonable endeavors to restore the Services as promptly as practicable.
